Did you buy a car with scam software? You will probably get money back
Compensating diesel car buyers with fraud software has been up in the air for a while. Now that the highest German court has decided that buyers must get back part of their purchase price, this should also be good news for the Dutch.
The European Court of Justice and the court in Haarlem had already agreed that compensation should be paid. It would be an amount of 3,000 euros.
How much money can you get back for a car with scam software?
In Germany it is not specified how much money you will get back. According to the judgment of the Federal Court of Justice, car owners are entitled to between 5% and 15% of the purchase price if manufacturers have falsified emission standards. This judgment was directed against Mercedes, Audi and Volkswagen.
The Diesel Emissions Justice Foundation, which is conducting class action lawsuits against five car manufacturers, importers and dealers, believes that this judgment could also affect decisions in the Netherlands. The organization even assumes that the Dutch judge will follow the German example.
Joost Edixhoven, one of the lawyers for the Diesel Emissions Justice Foundation: “In a recent hearing against Mercedes, we already predicted that this decision could turn the case in Germany. And that’s what happened today. If the manufacturer does not comply with the law, he is liable and the buyer is entitled to significant compensation. This is very good news for the victims. All manufacturers addressing emissions justice have similarly cheated but have so far evaded the dance. With this scale, it’s getting harder and harder.”
Compensation is already being paid in America
While in Europe not every buyer gets money back from manufacturers like Mercedes, Audi and Volkswagen, in America it is completely different. Volkswagen buyers have long been compensated here. It remains to be seen how and when the money will be returned in our country.
